1. Introduction to the RentMall Platform
Welcome to RentMall, an innovative platform connecting construction professionals with equipment rental providers. These Terms and Conditions govern your use of our platform.
2. Pilot Terms and Usage Limitations
RentMall is currently operating as a pilot program. During this phase, certain features may be limited or under testing. We reserve the right to modify, suspend, or discontinue any aspect of the service without prior notice.
Users are granted a limited, non-transferable license to access and use RentMall solely for legitimate business purposes related to equipment rental. Any use of automated systems or software to extract data from the platform for commercial purposes (‘screen scraping’) is prohibited.
3. User Obligations and Eligibility
To use RentMall, you must be at least 18 years old and capable of forming legally binding contracts. Users must:
- Register with accurate and complete information
- Maintain the confidentiality of their account credentials
- Not violate any applicable laws or regulations
- Not infringe on the rights of others
- Not impersonate another person or entity
- Not upload malicious code or interfere with platform functionality
4. RentMall’s Role
RentMall is a technology platform that facilitates connections between equipment renters and providers. RentMall is not a party to the rental agreement between users. All transactions, contracts, liabilities, obligations, and communications regarding the equipment are solely between the renter and the provider.
RentMall does not act as an agent, representative, guarantor, or insurer for any party. We do not control the quality, safety, legality, or accuracy of listings, nor do we endorse any user or equipment. You acknowledge and agree that RentMall assumes no responsibility for user interactions or disputes, including but not limited to equipment availability, payment disputes, damages, injuries, or delivery issues.
5. Equipment Use and Responsibility
RentMall does not verify the condition, legality, or safety of listed equipment. Renters are solely responsible for inspecting equipment and confirming it meets their requirements before agreeing to a rental. All claims or disputes related to equipment must be resolved between the parties involved.
6. Payments, Cancellations, and Fees
If RentMall facilitates payments, all payment processing will be handled through a third-party provider. Users agree to the terms of use and privacy policy of such provider. Fees may apply and are non-refundable unless explicitly stated. Cancellation policies are defined by the equipment providers.
7. Intellectual Property Rights
All content on RentMall (text, graphics, logos, icons, images, software) is the property of RentMall or its content suppliers and protected by international copyright laws.
Users retain ownership of content they submit but grant RentMall a worldwide, non-exclusive, royalty-free license to use and display that content to provide and promote services.
8. Disclaimers and Limitations of Liability
RentMall is provided ‘as is’ and ‘as available.’ We make no warranties regarding accuracy, availability, or reliability. To the maximum extent permitted by law, RentMall disclaims all liability for:
- Indirect, incidental, special, or consequential damages
- Equipment condition, suitability, or legal compliance
- User disputes, contractual disagreements, payment issues, or operational problems
- Any damage, injury, loss, or claims arising from rental transactions or platform use
You agree that your use of RentMall is at your sole risk and that you are solely responsible for evaluating equipment providers and rental terms.
9. Termination and Suspension
RentMall reserves the right to suspend or terminate user access at its sole discretion, including for violations of these terms or suspicious activity.
10. Changes to These Terms
We may update these terms from time to time. If changes are significant, we will notify users via the platform or email. Continued use after updates constitutes acceptance.
11. Governing Law and Jurisdiction
These terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA. Any disputes will be resolved in the courts of Delaware.
